Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BuzzList (“BuzzList,” “we,” “us,” or “our”), a hosted waitlist platform. By creating an account, embedding a BuzzList signup form, or otherwise using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use BuzzList.

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use BuzzList.
• You are responsible for your account, including keeping your email and sign-in link secure. Notify us promptly if you suspect unauthorized access.
• You are responsible for everything that happens through your account, including content submitted by people you invite as collaborators.

“Your Content” means waitlist names, slugs, branding, copy, subscriber data, and anything else you upload or submit through BuzzList.

• You retain all rights to Your Content. You grant BuzzList a worldwide, non-exclusive license to host, store, transmit, display, and otherwise process Your Content solely to operate and improve the service.
• You represent that you have all rights and consents necessary to collect, store, and use the subscriber data on your waitlists, and that doing so does not violate any law (including anti-spam, data protection, and privacy laws).
• You are the data controller for your subscribers' information; BuzzList is the data processor.

You agree not to use BuzzList to:

• Send unsolicited messages or otherwise violate anti-spam laws (including CAN-SPAM, CASL, and GDPR).
• Upload subscriber data without a lawful basis or appropriate consent.
• Distribute malware, phishing content, or content that is illegal, infringing, harassing, hateful, sexually explicit involving minors, or that incites violence.
• Attempt to bypass rate limits, plan limits, or any technical restrictions; reverse engineer the service; or probe its security without written authorization.
• Use the service to build or train a competing waitlist product.
• Use the public API in a way that overloads or destabilizes the service.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

• BuzzList offers a free plan and paid plans. Plan limits and features are described on the pricing page and may change from time to time.
• Paid subscriptions are billed in advance through Stripe on a recurring basis (monthly, unless otherwise stated). Fees are non-refundable except where required by law.
• You authorize us (through Stripe) to charge your payment method for all fees, taxes, and applicable charges.
• If a payment fails, we may suspend access to paid features until the balance is resolved.
• You can cancel at any time from the billing dashboard. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
• We may change pricing with at least 30 days' notice for existing paid subscribers; changes apply on your next renewal.

We work hard to keep BuzzList reliable but do not guarantee uninterrupted or error-free operation. We may add, modify, or remove features at any time. If we make a materially adverse change to a paid feature you rely on, we will provide reasonable notice.

BuzzList integrates with third-party services including Stripe (billing), Resend (email), Vercel (hosting), and our managed database provider. Your use of those services through BuzzList is also subject to their terms. We are not responsible for third-party services beyond our reasonable control.

BuzzList, including the software, design, logos, and documentation, is owned by us and our licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights. You may not use our trademarks without prior written permission.

• You may stop using BuzzList at any time and delete your account from the dashboard.
• We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if your account is inactive for an extended period.
• On termination, your right to use the service ends immediately. We will delete or anonymize your data as described in the Privacy Policy.

BuzzList is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

To the maximum extent permitted by law, BuzzList and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.

Our total liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD $100.

You agree to defend, indemnify, and hold harmless BuzzList from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) Your Content, (b) your use of the service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Indiana, and you consent to personal jurisdiction there. Nothing in this section limits any rights you have as a consumer under mandatory local law.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. If the changes are material, we will give reasonable notice (for example, by email or in-product). Continued use of BuzzList after the changes take effect constitutes acceptance of the updated Terms.

• These Terms, together with the Privacy Policy, are the entire agreement between you and BuzzList regarding the service.
• If any provision is unenforceable, the remaining provisions will remain in effect.
• Our failure to enforce a provision is not a waiver of our right to enforce it later.
• You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
